How we compiled this list
We include firms with a Melbourne office that handle TAC and car accident claims as a main part of their work. For each firm we read its own website in October 2026 and wrote the description ourselves, focusing on what it offers someone hurt on the road. Where a firm says a lawyer is an LIV accredited specialist in personal injury law we say so, and you can check the LIV's specialist directory. Free consultations and fee terms are as the firm describes them, so confirm them in your costs agreement. We show Google ratings with the date we checked them, and we leave out self-reported results and success rates.
No firm pays for its place on this list, and the order is our own. We write the descriptions ourselves, and firms don't get to edit them. If something here is out of date, let us know. There's more detail on how we rank law firms.
This page is general information, not legal advice. Rules and amounts are as published by the TAC, VCAT, WorkSafe Victoria, the Victorian Legal Services Board and Commissioner and the Victorian Government Solicitor's Office in October 2026.
After a car accident: making a TAC claim
The TAC covers people injured in transport accidents in Victoria and pays benefits regardless of who was at fault.
What you need to do
Time limit
Get the police report number, or the officer's name, badge number and station. The TAC claim needs it
Before you lodge the claim
Lodge your TAC claim
Within 1 year of the accident, or of when the injury first appeared. The TAC may accept a late claim if it's made within 3 years of the accident and there are reasonable grounds for the delay
A child's own claim, if no claim was made for them
Up until the day before they turn 21
If you were injured at work in a transport accident, for example driving for your job, claim through WorkSafe first. You don't need a lawyer to lodge a TAC claim, and you can call the TAC on 1300 654 329. A lawyer becomes more useful when a claim is rejected, payments are cut or refused, or your injury may be serious enough for a lump sum.
What the TAC pays: income support and impairment lump sums
TAC no fault benefits don't depend on proving anyone was to blame. The two that matter most for many people are income support and the impairment lump sum.
Income support: usually 80% of your gross pre-accident income, up to $1,730 a week from 1 July 2026, if you've had more than 5 days off work. The first 5 days aren't paid. It runs for up to 18 months. After that you may get a loss of earning capacity benefit, which depends on your capacity to work and for most people ends 3 years after the accident unless your impairment is 50% or more
Impairment lump sum: a one off payment for adults with a permanent impairment from the accident assessed at 11% or more. Your injuries must be stable, and unlikely to change, before they're assessed. For children, the TAC instead pays a weekly benefit to the parent or guardian ($244 a week from 1 July 2026) from 18 months after the accident until the child turns 18
Impairment rating

15%

Amounts are for accidents on or after 16 December 2004 and are indexed each 1 July. If you disagree with your impairment rating, you can challenge it the same way as other TAC decisions, set out below.
When someone dies. The TAC's indexation schedule from 1 July 2026 lists a fatal dependency lump sum of $237,240, and funeral expenses of $19,940 for accidents on or after 20 November 2013. Ask the TAC or a lawyer which payments apply to your family.
Serious injury and common law damages
On top of no fault benefits, you may be able to claim common law damages, a lump sum. Two things are needed: your injury must be a serious injury, and someone else must have been negligent.
Serious injury: an impairment of 30% or more counts. Below that, the TAC can still certify a serious injury based on its long term effect on your life
If the TAC refuses: you can apply to the County Court, which decides serious injury applications
Time limit: common law proceedings generally must start within 6 years of the accident, or from age 18 for a child
TAC common law amounts from 1 July 2026
Amount
Threshold for pain and suffering damages, and for lost earnings damages
$70,130
Maximum for pain and suffering
$701,620
Maximum for lost earnings
$1,578,760
The TAC says common law claims settle on average about 12 months after they're lodged, and complex claims can take two years or more. Lawyers often wait until your condition has stabilised before settling, so the timing of a serious injury application is worth talking through early.
Disputing a TAC decision: review, dispute resolution and VCAT
If the TAC refuses a claim, a treatment or a benefit, or you disagree with your impairment rating, there are three ways to challenge it. Each has a 12 month limit, so don't wait.
Option
How it works
Time limit
Informal review
A TAC Review Officer who works separately from the area that made the decision looks at it again. It's free
Within 12 months of the date of the decision letter. It doesn't put your VCAT time limit on hold
Dispute resolution
A process set up by the TAC, the Law Institute of Victoria and the Australian Lawyers Alliance, run through your lawyer. Your lawyer and the TAC exchange information and, if needed, hold a conference. The aim is to resolve it within 120 days, and the TAC pays for things like an independent mediator
Within 12 months of becoming aware of the decision
VCAT
The tribunal reviews the decision. You lodge an application for review on the prescribed form, and a fee applies
Within 12 months of becoming aware of the decision, or 3 months after notice of the outcome of a pre-issue review, whichever is later
If you have a lawyer, the TAC's protocols expect disputes to go through dispute resolution first before a VCAT application, though steps can be skipped by agreement. You can still apply to VCAT directly within the time limit. If dispute resolution ends with the TAC's decision changed or the dispute resolved, the TAC may pay legal costs under the protocol.
At VCAT, people in financial hardship, including Health Care Card holders, can ask for the fee to be waived, reduced or postponed. If the TAC's decision is overturned or varied and you have a lawyer, the TAC may be ordered to pay your standard legal costs. If the decision is upheld, you may be ordered to pay costs. You can apply to VCAT online or on a printable form, and VCAT's number is 1300 018 228.

What a Melbourne car accident lawyer costs, and free help
Most car accident lawyers work on a no win, no fee basis, which means you pay their professional fees only if the claim succeeds. A few rules apply in Victoria:
Costs disclosure: if your legal costs are likely to be more than $750, your lawyer must tell you in writing how they'll charge
No win, no fee agreements: must be in writing, in plain language, and set out what counts as success. You may still pay disbursements such as medical reports
Percentage fees: Victorian lawyers can't charge a share of your payout, except under a court order in a Supreme Court class action
What the TAC pays: in a successful common law claim, the TAC may pay some of your legal costs directly to your lawyer

Melbourne car accident law: common questions
How long do I have to make a TAC claim?
Within 1 year of the accident, or of when the injury first appeared. The TAC may accept a late claim if it's made within 3 years of the accident and you have reasonable grounds for the delay. If no claim was made for a child, they can make their own claim up until the day before they turn 21. A common law damages claim generally has to start within 6 years.
Can I claim from the TAC if the accident was my fault?
Yes. The TAC pays no fault benefits such as income support and medical costs regardless of who was at fault. To claim common law damages, though, someone else must have been negligent and your injury must be a serious injury.
What counts as a serious injury?
An impairment of 30% or more counts. Below that, the TAC can still certify a serious injury based on its long term effect on your life. If the TAC refuses a serious injury certificate, you can apply to the County Court.
How much is the TAC impairment lump sum?
From 1 July 2026 it starts at $9,890 for an 11% impairment and goes up to $451,650 at 100%. Nothing is paid for an impairment of 10% or less, and your injuries must be stable before they're assessed. For a child, the TAC pays a weekly benefit to the parent or guardian instead, from 18 months after the accident until the child turns 18. Apply within 6 years of the accident, of when the injury first appeared, or from age 18 for a child.
What can I do if the TAC refuses treatment or cuts my benefits?
Ask for a free informal review, use the TAC's dispute resolution process through your lawyer, or apply to VCAT. Each has a 12 month limit, and an informal review doesn't stop the VCAT clock.
What if I was hurt while driving for work?
If you were injured at work in a transport accident, claim through WorkSafe first. Tell your employer as soon as possible, and within 30 days, ideally in writing. WorkSafe Advisory is on 1800 136 089.
Do I need a lawyer for a TAC claim?
Not to lodge one, which you can do yourself. A lawyer is more useful if the TAC refuses something, if you want to use the TAC's dispute resolution process, or if you may have a serious injury and a common law claim. Victorian lawyers can't take a percentage of your compensation as their fee.
